‘Unconstitutional censorship’

According to a lawsuit filed Friday by three Twitter users, the government’s continued pressure to censor and report alleged COVID-19 misinformation on social media platforms is a “state measure” that violates the First Amendment.

Representing the New Civil Liberties Alliance (NCLA), a frequent litigant against covid-related administrative action, theoretical scientist Mark Changizi, lawyer Michael Sanger, and in-house father Daniel Kotzin.

Surgeon General Vivek Murthy, including “The impact and prevalence of health misinformation in the digital information environment during the COVID-19 epidemic”, temporarily suspended Kotjin and Sanger within a week of the March 3 information (RFI) request. . “

RFI covers not only search engines and social media but also e-commerce platforms and instant messaging systems, “persuading technology companies to increase censorship for fear of adverse action against them,” the lawsuit states.

The statue transcends the statutory powers of its office, which allows it to segregate people who are “reasonably believed” to be infected and communicable to prevent interstate infections, the NCLA claimed. On the same legal grounds, the Supreme Court ruled that the CDC’s covid eviction was inadmissible.
